But here’s my issue with this ad to the right–if you are the owner of the property that is listed in this ad, which is in our Phoenix market or wherever else (Scottsdale, Glendale,Chandler,Gilbert, Ahwautukee,Peoria,etc) then why should your home be sold for less than market value? We are at a very low level of inventory with huge demand so your home should be selling for market value or above here in Phoenix. It’s that simple.

I get it. The agent probably wants the phone to ring. I am not saying they did something unethical. But if you are the buyer, and you call because it is under market but find out it really isn’t, isn’t that misleading? I think it is. I am not saying that agent is being misleading-I don’t know enough about the homes and deals he/she has but why would anything in this market be sold for less than market value?

It doesn’t matter who the seller is-bank, “regular” seller, short sale seller-your agent should always try to get you the most money possible in this market that is now happening in Phoenix and other Phoenix areas. In other markets, maybe selling quicker for less is better. Here’s the other thing-buyers determine value, not comps. And in a market where there is a ton of demand, your agent should be creating additional value for your home. That’s when price only becomes a factor-in the absence of value.

I had to check out some different rehab facilities for someone and was arriving at my 2nd one for the day. As I drove through the parking lot I thought to myself, “Self, what am I doing here? This place doesn’t look the greatest and the other place was so much better.” I parked my car, and walked inside.

I hear so many times the kind of car you drive is important, or where you live, or what you wear.

Due to some different circumstances I have sometimes showed up on appointments in my other vehicle–a 2 door Honda Civic, usually very dirty with bird crap on it (parked outside and no time to clean it), and stuff everywhere inside. Should it matter to my client? I am not sure but if it does I am probably not a good fit anyway.

“I saw your blog post about how the banks won’t approve principal reductions for people who are struggling financially.

You recommended that anyone upside down should short sale their house because that is the only way to get the amount they owe reduced.

These people took out a loan and made a promise to do everything in their power to repay it. I think it is wrong that you would openly recommend them break that promise.

All that does is make it harder for someone responsible to get a loan. They banks have lost so much money because people walked away from their mortgages that they are making it impossible for responsible people to get a mortgage. Andrew.”

Here was my response to Andrew’s email.

“Andrew, thank you for your opinion. Fortunately we live in America and everyone is entitled to their opinion. I can understand that you are frustrated. It sounds like this has affected you personally when you tried to borrow money. But, let me ask you this. I meet a homeowner named John. John’s company went under during the economic crisis and John lost his job. He was out of work for six months and burned up all his savings and retirement accounts trying to stay afloat. Today John is working 2 jobs, but making less money than he did at his previous 1 job. He cannot afford his mortgage payment. His lender will not reduce the payment to where he can afford it. If he pays it, then he can’t pay for groceries. He makes too much money to qualify for food stamps. So, what should he do? Should he get a third job, work until he burns out, and then lose everything? Or, should he move to a more affordable house and try to get his life back on track? I think he should do whatever he can to get his life back on track, whether that be a loan modification or short sale. I know you may think he should work 80 or 100 hours a week until he has repaid every single debt in full.

Ultimately John and his family have to do what makes sense for them. Fortunately, America gives you the freedom to make your own decisions on what is best for you. Thinking about a short sale?

They are friendly and fun to work with. This is one of the things I like about selling short sales for a living. The downside is that every once in a while a negotiator will get an attitude.

For whatever reason they have decided to go on a power trip. They start asking for unnecessary paperwork. Or, they nitpick the paperwork you send to them.

Most agents just kowtow to the negotiator. They think that the negotiator has all of the power. I have found that isn’t true. The negotiator has very limited power.

After all, they don’t own the bank. They aren’t the one who will be losing money on the loan. The fact is most banks lose a substantial amount of money when they turn down a short sale.

As an example, a bank turned down a $190,000 offer on a short sale. The property sold about 18 months later. But, this time it didn’t sell for $190,000. It sold for $165,000. Not only did that bank lose $25,000 on the sales price. They also paid the property taxes and insurance for that amount of time. In addition, they were unable to lend that money and earn interest. I estimate they lost an additional $15,000 when you factor in the interest. That’s a $40,000 loss. When a short sale negotiator gets an attitude I simply remind them of this. And I tell them I will be holding them accountable if they turn down the short sale and the bank loses more money as a result. Needless to say, they lose the attitude. Thinking about a short sale? The house is a problem. Since 2006 my house price has dropped by about $40,000. That means I have a $40,000 deficiency, which I don’t want to pay.

I have option to rent the house, but I am still considering a short sale. Any advice? Sergio.”

Here was our answer to Sergio’s Question: Sergio, I would attempt a short sale. Depending on your situation and the type of loan you have, more than likely you will not have a deficiency. I can give you a better answer after I get more information from you. I wouldn’t recommend renting the house. How hard is it going to be to manage when you are out of state? What if the tenants stop paying? What if a pipe breaks and floods the house? I’m not saying don’t rent the house. I just know from past experience that managing rental property from a distance is super tough. I knew a real estate investor who targeted what he called “tired, out of town landlords.” He would offer to buy their property below market. Surprisingly, many of them accepted his lowball offers because they were so tired of dealing with the property. Here is the other downside on renting. You will probably have negative cash flow every month. I don’t know what your house will rent for. But, if you are upside down on your house value, then you are likely also upside down on the rental value. That means you will almost certainly lose money on the rent every month. With your precarious financial situation, recent 30% salary cut, and move out of state, the last thing you need is another bill each month.

With a short sale you can walk away owing nothing, with no tax liability, and be eligible to buy another house in 3 years.

That sounds a lot better to me than being stuck with a money losing house 2 years from now. Thinking about a short sale?

As someone who bought their first home in Chandler (about a mile from here) almost 15 years ago I will always consider Chandler my home. It has awesome well built communities with excellent freeway access, shopping that rivals Scottsdale and Glendale and so much more.

One of the other things which the City has done so well is the revitalization of Downtown Chandler. While this is nothing like Old Town Scottsdale I am not sure it has to be or anyone wants it to be. What made Old Town so popular is/was its uniqueness. What makes Downtown Chandler is its uniqueness.

Have you ever noticed how apartment complexes have to work hard to rent their apartments? Meanwhile, most single family homes are rented without much effort. Homes tend to attract more stable tenants that are older and have more stable, established jobs. How to avoid problems with a rental property. Before agreeing to rent to a prospective tenant, ask to look at their financials. Banks ask for copies of tax returns, bank statements, and pay stubs before approving a loan. I don’t think a tax return is necessary.  But, you can get a much better idea of whether or not someone can pay you when you have copies of bank statements and/or pay stubs. It will be very hard to get this from someone renting an apartment. But, there are much less homes for rent and more people looking to rent a home.
